What makes this especially insidious is that it cannot even be challenged in an American court as a violation of the First Amendment as it’s not the government that’s saying “you can’t write this,” it’s the merchant who’s saying “we won’t sell this.” While the government cannot abridge the freedom of speech, it’s perfectly legal for a privately-held corporation to act in such a manner as to effectively shut down freedom of speech. But I don’t think this will last long. If Amazon or B&N won’t sell the book someone else eventually will. That’s the free market. It’s just too bad someone can’t take Amazon and B&N to court on this.
